By purchasing and using Loud & Clear Marketing's services, you agree to the following terms and conditions. These terms outline the expectations, responsibilities, and limitations of liability for both parties.
1. Service Scope
Loud & Clear Marketing offers a variety of services designed to help businesses grow and achieve their marketing goals. These services include, but are not limited to:
- Social Media Marketing and Management: Content creation and posting, audience engagement, analytics, and performance tracking.
- Advertising Services: Google Ads, Facebook Ads, Instagram Ads, and targeted display ads.
- Podcast and Digital Publication Support: Podcast setup and management, digital publication guidance.
- Book Publishing Assistance: Publishing on Amazon, publishing on Barnes & Noble, and full rights publishing.
- Google Reviews Management: Review collection, management, and reputation monitoring.
- Text and Email Marketing: Campaign design and execution, list management, segmentation, and automated email sequences.
- Ultimate Marketing Package: A comprehensive 3-month marketing strategy tailored to your company, brand, product, or event.
- AI 30+ Video Ads: Creation of 30+ AI-generated video ads for your company or product.
- 5X Growth Package: Five posts per week, with one month of social media management.
Additionally, Loud & Clear Marketing and its affiliated companies or partners may provide services, advice, or tips that may include guidance on marketing strategies, digital presence, audience targeting, branding, or other related areas. These recommendations are provided in good faith but are not guaranteed to result in specific outcomes, as success depends on several variables, including market trends and external factors.
2. Refund, Return, and Exchange Policy
- No Refunds, No Exchanges: All sales are final. Once a service is purchased, it cannot be refunded, exchanged, or transferred.
- One Brand, One Client Policy: Each service package can only be used to manage one brand, one person, or one business at a time. If you wish to manage multiple brands, additional packages must be purchased.
3. Liability and Indemnity
- Content Liability: If Loud & Clear Marketing posts content that leads to negative audience reactions, brand reputation issues, or client dissatisfaction, Loud & Clear Marketing is not liable.
- Legal Liability: If a post contains incorrect, inaccurate, or incomplete information, you cannot sue Loud & Clear Marketing for damages or losses.
- Data Breach and Loss: Loud & Clear Marketing implements industry-standard security protocols to protect your data. However, in the event of a data breach, data loss, or unauthorized access, Loud & Clear Marketing is not liable for any damages, disruptions, or losses incurred.
4. Confidentiality and Privacy
- Client Confidentiality: Loud & Clear Marketing will not disclose your confidential information or sensitive business data to third parties without your consent.
- Use of Client Work for Promotion: By using our services, you agree that Loud & Clear Marketing may use your work as a testimonial, case study, or work sample for marketing and promotional purposes. This usage will be limited to showcasing our work capabilities.
5. Use of AI & Human Resources
- AI Usage Disclaimer: Our services involve AI to generate copy, designs, and creative content. While this accelerates production, it may also introduce errors in data, context, or design. Loud & Clear Marketing will not be liable for any such errors.
- Human Involvement: Human editors and designers support the process to maintain quality. However, errors may still occur.
6. Copyright & Intellectual Property
- Client IP: Content (such as logos, brand colors, and proprietary visuals) provided by you for use in social media posts remains your intellectual property. Loud & Clear Marketing will not claim ownership.
- Loud & Clear Marketing IP: All content produced by Loud & Clear Marketing (designs, posts, templates, etc.) remains the intellectual property of Loud & Clear Marketing until full payment is received.
7. Disclaimer of Warranties
Loud & Clear Marketing makes no guarantees regarding social media growth, follower engagement, or client satisfaction. Success depends on multiple variables outside our control, including market trends, platform changes, and audience behavior.
8. Dispute Resolution
Any disputes arising from this agreement shall be resolved through arbitration. Legal claims against Loud & Clear Marketing are not permitted as per the terms of this agreement.
